MARY ROBERTS. REMSEN, ONEIDA COUNTY, NEW YORK.

I Mary Roberts of the Town of Remsen in the County of Oneida and State of New York, being of sound mind and memory do make, ordain, publish and declare this to be my last Will and Testament that is to say.

First. After all my lawful debts are paid and discharged, I give and bequeath to the Welsh Calvinistic Methodist Church at Remsen in Oneida County commonly known as Pen y Graig Church, one thousand dollars to be kept invested by the trustees of said Church in bond and mortgage and the interest thereof to be expended annually in building and repairing the fences about the burying ground belonging to the said Church and adjoining the Church yard. Also, for improving such burial ground and if the Church members or the majority of them shall at any time deem such interest more than sufficient for such purpose, then the surplus of such interest may be used for repairing the Church, but no part of said interest to be applied for any other purpose than as above mentioned, and no part of the thousand dollars to be expended for any purpose at any time, only the interest thereof to be expended.

Second. I give and devise to my cousin Eleanor Price, wife of William J. Price of remsen all of the land I own in the Town of Remsen in Oneida County, and being the same piece of land owned by my father John Roberts and my brother Evan Roberts jointly, previous to their decease and lying East of the above named Church, and joining on said burying ground and consisting of about sixty acres of land, conditioned that said Eleanor Price pay or cause to be paid to the Trustees of the Welsh Calvinistic Methodist Church known as the Pen y Graig Church at Remsen one thousand dollars, and being the amount mentioned in the first bequest to be paid to said Church, then said land is to be and remain hers absolutely and for ever.

I also give to my said cousin Eleanor Price my Bank Book, and all that may be remaining unpaid thereon at the time of my decease except sufficient thereof to pay my funeral expenses, and to furnish a tomb stone to my grave similar to the stone at my father's grave, at an expense of about fifty dollars. I also give my cousin Eleanor Price aforenamed all the rest of my lands for the present year.

Third. I give and devise the farm I now own in the Town of Steuben in the County of Oneida and being the same formerly owned by my father at the time of his decease, to Evan Perry of French Road of Steuben aforesaid upon condition that he pay the following bequests viz :

One hundred dollars to my father's cousin Robert T. Griffith.
Six hundred dollars to my cousin Thomas J. Evans of Remsen.
Three hundred dollars to my cousin Jane Perry, wife of Henry Perry of Steuben aforesaid.
One hundred dollars to my cousin Rowland Evans of Steuben aforesaid.
Two hundred dollars to my cousin Mary Edwards, wife of John Edwards of Utica, Oneida County.
Two hundred dollars to my cousin Hezekiah J. Evans of Utica, Oneida County.
One hundred dollars to my cousin Francis Evans of Remsen, Oneida County.
Two hundred dollars to my aunt Catherine Evans of Remsen aforesaid and one hundred dollars to my cousin Eleanor Jones.

I also bequeath the timber from one acre of woodland on the above mentioned farm, and on the west end thereof and next to the cleared land thereon to William J. Price of Remsen.

Then the said above last mentioned farm after the payment by Evan Perry Junior of the terms above mentioned by him to be paid and the granting of said wood is to be and remain the property of said Evan Perry Junior absolutely for ever.

All the rest, residue and remainder of my property not herein before mentioned I give and bequeath to Evan Perry Junior to be his absolutely.

Likewise, I make, constitute and appoint Evan Perry Junior to be Executor of this my last Will and Testament hereby revoking all former Wills by me made.

In witness whereof, I have hereunto subscribed my name and affixed my seal, the 22nd day of June in the year of our Lord one thousand eight hundred and seventy five.

The above instrument consisting of one sheet, was at the date hereof subscribed by Mary Roberts in the presence of us and each of us, she at the time of making such subscription acknowledged that she made the same and declared the said instrument so subscribed by her to be her last Will and Testament, whereupon we then and there at her request, and in the presence and in the presence of each other subscribed our names as witnesses thereto.
