MR. RICHARD PRITCHARD. IOWA, USA.

In the matter of the estate of Richard Pritchard deceased.
Be it remembered that on the 26th day of August A. D. 1902, there was filed in the office of the Clerk of the District Court of the State of Iowa in and for Floyd County a paper purporting to be the last Will and Testament of Richard Pritchard, late of said county, deceased, which said will was opened and publicly read and Monday the 8th day of September 1902, finally fixed by the judge under application of Jane Pritchard filed August 28th 1902, said application and order being among the files of this estate and made apart of this record.

It was further ordered by the judge that notice of the time so fixed be given by publication in the Floyd County Advocate at least five days before time fixed for said hearing, said paper being a weekly newspaper printed and published in said Floyd County Iowa.

And now on this 8th day of September 1902, it being the first day of the term and the day fixed for the hearing of this Will, it comes on to be heard befor ethe court.

And it appearing that due notice of the time of final hearing on the application for admission of this will to probate to all parties interested by publication thereof has been made as required by law, proof of which is duly on file in the clerks office, and no one appearing to resist the probate of said will, they are adjudged in default.

And the instrument purporting to be the last will of said deceased being produced, and the testimony of the subscribing witnesses thereto being heard, the court finds that said instrument was duly signed by said deceased, as and for his last Will and Testament; that at that time said deceased was of sound mind; that he then declared said instrument to be his last Will in the presence of P. W. Burr and James D. Shaw, the subscribing witnesses thereto, who then, in the presence of said deceased and in the presence of each other, and at the special request of said deceased, signed their names as witnesses thereto.

Said Will is in words and figures following to wit :
In the name of God, Amen.

I, Richard Pritchard, of Niles, Township, Floyd County, Iowa, being of sound disposing mind and memory, do hereby make, publish and declare this to be my last Will and Testament, hereby revoking all former Wills by me at any time made.

First : I direct that all my just debts, funeral expenses, expenses of my last sickness, and all other lawful charges against my estate be first paid out of my personal property, of which I may die the owner, so far as same can be done.

Second : I give devise and bequeath unto my wife Jane Pritchard, the use, income and profits of all the real estate and personal property, of which I may die the owner, during her natural life.

Third : I hereby give, devise and bequeath unto my son, Robert Pritchard, of Hubbard, Minnesota: my son, William Pritchard od Seattle Washington: my daughter. Anna Duncan, of Riceville, Iowa: Marise Pritchard od Miles Township, Floyd County, Iowa, and my grandson Richard Hill of Miles Township, Floyd County, Iowa; all the rest, residue and remainder of my property, share and share alike, to be theirs absolutely upon the death of my said wife, but they shall not be entitled to the use income or profits of any of said property until after the death of my wife, as aforesaid, but until her death she shall receive all the use, income, rents and profits therefrom for her own benefit and comfort.

Fourth : I have not made any devise or bequest to my daughter Rozilla Hill, for the reason that I have deemed it for the best interests of all concerned to give and bequeath same to her son, Richard Hill.

Fifth : I hereby nominate and appoint Levi Duncan of Riscville, Iowa to be Executor of this my last Will and Testament.

In witness whereof, I have hereunto set my hand this 16th day of July A. D. 1902.

The foregoing instrument in writing was on the 16th day of July A. D. 1902, subscribed in our presence by Richard Pritchard, and he at the same time declared the same to be his last will and testament, and at his request and in his presence, we have subscribed our names hereto as witnesses thereof.
